The effects of poorly labeled medication

Pennsylvania pharmacists are aware that medication may be considered mislabeled if the wrong instruction are printed on it or there are insufficient warnings printed on its label. It could also be mislabeled because someone misidentified the drug in the container. When a medication has an incorrect label, there is a high likelihood of harm to the patient who uses it. In some cases, death is possible for those who take the wrong medication or take an improper dose.

In one 2013 case involving Teva Pharmaceuticals, six people were killed after patients took mislabeled medications. However, the company itself was cleared of negligence by the French National Medicine Security Agency. The label on the medication said that it contained furosemide, which was used to treat patients with cardiac issues. However, the medication was actually a sedative called zopiclone.

If an individual is provided an improper medication or an improper dose of a drug that he or she is supposed to take, it could be grounds for legal action. It may be possible to hold the doctor who made the error liable for injuries and even wrongful death if a patient dies. The manufacturer of a defective medication may also be held financially liable if it contributed to a situation resulting in a patient getting the wrong medication.

An attorney may be able to review the facts in a case and determine if a doctor or other medical professional was negligent. If medical malpractice can be demonstrated, injured patients may be entitled to compensation for medical bills and other financial damages that have been incurred as a result.
