Motorcycle Insurance Policy Consequences

If you've been in a motorcycle collision caused by another driver's negligence, it is reasonable to expect the other driver's insurance policy to cover your costs. Under Pennsylvania law, however, the type of insurance you carry can make an important difference.

In Pennsylvania, if you have purchased "limited tort" insurance, you may not be entitled to compensation for your injuries unless you have suffered a serious impairment of a bodily function, scarring or disfigurement. There are some exceptions, however. For example, if you were hit by an out-of-state vehicle, a drunk driver or were occupying a commercial vehicle, you are likely entitled to full compensation, no matter what your policy provides (even if it is a "limited tort" policy).
